No Title

I ran across a 2011 Ninja 250 that had a minor low side. I want to buy it and make it track only so I can race it in the local 250 series with friends.

The person left it at a shop after the low side and did not want to pay for the damage estimate and storage fees. The shop kept the bike since the owner would not pay but the shop does not have the title.

Don't I need the title to prove ownership even though it will be track only?

Can the owner holding the title take ownership from me at any time since he still holds the title?

The shop said they will give me a written receipt and the price is right but not sure on the no title part.

I am leaning towards telling the shop no title, no deal but maybe since it will be track only I am wrong.

The shop can also apply for an abandon vehicle title if your state have that but DMV would be able to give you more info on that.

In Ontario, the shop would place a Mechanic's Lien on it (registered with the court through the MTO- same as the DMV), then after 30 days (I believe) they can have the title transferred to them.

I don't know what the law is in your state, but I would never take a vehicle that didn't have proper title signed over to me. You don't need some bozo showing up at your door demanding his bike back, or swearing out a warrent for your arrest for bike theft. Your plan is good...let the shop sort it out before you give them a dime.
