I don't think that every possible scenario where a crash is involved is 100% riders error. If your lane splitting and your parallel next to a car and the accidently jerk the wheel just enough to hit you, that's rider error? or there was a video of some guys hitting twisties and they were going around a corner or about to and the oncoming rider wipes out right infront of him and his bike slides into him within a second, that's rider error too? I don't lane split because of two reasons 1) I personally think it's completely retarded and unsafe unless at a stop light or in a dead stop traffic and 2) it's illegal in my state and alot of other states. You're right. It's probably about 99%. If a car drifts towards you and causes you to crash you're riding too slow. Cars always have a tendency to drift from one side of the lane to the other especially if they see you in the mirror. So you watch that and make your move. The longer you ride the better you get. I've been doing it so long that i'm more comfortable on my bike splitting lanes than I am driving a car.
