Marine faces 15 years behind bars for unknowingly violating gun law

Ryan Jerome was enjoying his first trip to New York City on business when the former Marine Corps gunner walked up to a security officer at the Empire State Building and asked where he should check his gun.
That was when Jeromeís nightmare began. The security officer called police and Jerome spent the next two days in jail.
The 28-year-old with no criminal history now faces a mandatory minimum sentence of three and a half years in prison....

I can somewhat see the security threat and disciplinary measures they might have to take if they CAUGHT him with the firearm, but he voluntarily asked where he could check it. He was obviously not being a threat. I understand that after 9/11, New York probably wants to be firm with their laws and want him to serve as a warning, but I'd simply slap him with a fine, ship the firearm at his expense to an FFL in Indiana and be done with it.

Wow.. this is unbelievable.

With the way our laws are going now; I am would not bother owning a concealed gun.

Serving the country and getting screwed by the system.. Its a simple lapse of judgement that most anyone can make who isn't familiar with New York's gun laws...

Even though I agree the sentence is an overkill, it is still the gun owner's responsibility to know the law wherever they carry their firearms. Most, if not all, concealed carry permits are not applicable to all 50 states. Living in Southeastern PA and so close to the People's Republic of New Jersey, I never carry across the state line. Their gun laws are ridiculous! If you go to a gun show in PA, they have signs that state something along the lines of, 'Cannot buy this if you are a NJ resident'. It sucks for this guy if he is sentenced to 3.5 years, but hopefully it will remind other gun owners to check state laws before traveling.

maybe he should have thought about finding out what ny gun laws are before he came here?

I would think that would be one of the things you learn when you get a gun permit...

Being a Marine Gunny I highly doubt he just assumed he could go anywhere with it. It states he did research on NY gun laws but the information was inaccurate. I've done a lot of research online about local MN gun laws and I find a lot of sites have misleading or confusing information. I've even tried contacting the local Sheriff Department asking for clarification on subjects and I never hear anything back.

I agree with dJt3xtbook. He clearly wasn't a threat and was being responsible by trying to check the weapon in. The problem he will run into is bias court systems that wont use common sense and reasoning. Instead they will try and make an example of him.
