So has anyone been booked after droping there bike??
I crashed my baby 2 months ago, just rider error, went straight when i should have turned the corner but got booked for neg driving, has this happened to anyone else...???
It happens mate..the cops are fuckers about this sometimes. You can take it to court cos they can only make it stick if they prove you were being negligent and it sounds like you just made a mistake.
I had the cop that came out to our Hotham ride last year where I launched myself and my bike about 30 meters down a ravine and he couldn't be fucked doing any paperwork cos he was the local cop and they had called him away from a tennis or cricket match or something. He laughed cos the area of Omeo that I crashed in was 60k limited when we were doing 200k+ sweepers and he could tell I was speeding by how far the bike had been launched. So it's all luck mate cos I would have deserved a negligent then but didn't get it. Mind you, fucking Omeo could erect an intersection sign considering there's 40 min of twisties that suddenly go into an intersection and the only slight warning that there might be something was the drop in speed limit to 60. Had there been one of those yellow intersection signs I would not have crashed.

Any accident that the police attend someone gets booked. The only time they dont is if they say there is loose gravel or oil or something on the road... Face it, if you crash, you were doing something wrong!
I dont agree Bee...well I agree that they book most ppl after stacks (not all) but dont agree with your logic. If your not speeding or breaking any other road rules but crash, then you don't deserve a fine.
Hey dont get me wrong, i did do something wrong, i rode straight, when i should have turned the corner....stupid i know..... i just dont like paying money to the government, for a fat cop to come out say" you got to be soft if your not doing 140 through there, so he must have been speeding"....... I just dont like cops, but i guess i deserve it.
No, making a mistake and breaking the road rules are 2 different things and you should only be fined if you have done something negligent.
I'd fight it in court!
I got a penalty notice (the charge below a neg driving charge - $130 and 2 points) when i crashed earlyer in the year. I lost the front end in a corner and the bike slid into a car, the cop said if two vehicials are involved somone pritty much has to be charged, i wasn't speeding and i was on the right side of the road so technically i wasnt doing anything wrong.... His explanation as to why i got a ticket is that i was riding caerlessly as a carefull rider wouldn't have lost control....

Well the one thing that i have learned is to buy a van.....If anything like this happens again( Shit i hope it doesnt!!) Ill get my mates or even my mum, to come pick me up real quick, and if its a really bad crash, i can always lie in the back

you also gotta remember that the opposite can happen too...
you could be breaking 5 or 6 road rules but then only get fined for the most minor of them all...

In NSW neg driving is the standard fine for any single vehicle accident involving a bike (and possibly cars). If cops attend an accident you can be sure at least one person is going to be charged with something. Even gravel and oil generally wont save you from a neg driving charge. However i do know people that have fought and won in court, but generally you need to prove unusual/unpredictable circumstances.
If you crash on your own, dont let anyone call the cops and get your bike away from the road ASAP. If you crash on gravel or oil you are going to have to prove lack of signs or be able to prove specifically who dropped the oil/gravel - chances arent good.
Moving the bike and not calling would have been the smart thing to do......but i had two broken collar bones and crushed ribs, and had passed out for a bit too, so yeah sometimes its a bit hard to avoid "The Law"....

the logic is that if you have an accident and you are at fault then it is negligent driving, same in a car, except that normally the car can just pull back off the grass and drive home.
well..umm ...well.... it hapened out at the cotter but the stupid thing is it wasnt even on a hard corner, and i (use to) ride the cotter so very very very much, so it wasnt lack of knowing the road, and there wasnt anything on the road that made me come unstuck, just a stupid mistake by me....which i can except, i blacked out for most of it, so i dont really know why i crashed........ (unlike the video camera that was straped to my tank, it got everything).... but i wasnt doing anything stupid!! just riding,
I guess i just dont like paying money for a fine.... but im alive, and will learn from my mistake....thats the important thing....
