i got busted for an 88 in a 55 -- only 33 compared to your 40.... but a good lawyer could get it dropped or at the least made into a lesser charge...

my lawyer talked to the DA fiirst and got it dropped to 19 over... then when my case came up he asked the judge for a "prayer for judgement" and it was granted... only works for a first offense --- a prayer for judgement is: if you dont get another ticket in a year it will drop off... BUT if you get one within the year both will be on your liscense...

no suggestions for lawyers cause the lawyer has to be from the county you got your ticket in (to my best understanding) but remeber.... you DO get what you pay for... i paid $400 for mine and that was in '99.....

good luck mayn!!

Not sure how it works down there but up here in NY alot of times if you plead not guilty the DAs will work with you over getting it lowered(moving violation)you still pay a good fine but it keeps it off your record.Good luck http://www.gixxer.com/forums/images/graemlins/thumb.gif

In NJ most of the time you can plead the sentence down by talking to the prosecutor. But the judge has to approve/disapprove. Most of the time most counties just want their money.

There's a book all about avoiding speeding tickets...

It says you should...

1. Challenge it and bring it to court. Make SURE you know what they caught you with, Radar/Laser or clocking (timed you from one point to another to determine speed)

2. If the cop doesn't show on the court date, you win automatically. Something about contesting it and them not being there to defend their judgement and such, it ties in with the next one.

3. Subpoena records of the calibration of the speed checking device and use them in court. Those devices must be calibrated every so often, otherwise they could give "false readings." If yer cop hasn't had his done, based on records, then you can argue that he got a false reading on his device and you get off the ticket.

4. If they use the "clocking" method... You have your attorney or yourself drop a ball and tell the cop to tell you how fast it was going, by timing it from one point to the next... all objects fall at a constant rate... but if they don't know this and can't answer... you get the ticket off yer record.

Dunno if that helps, and you may wanna see if those methods work if yer desperate. Either that or take the class to void the points on yer record, and then pay the lower fee as a result. At least that's how it works in FL.

What's the name of that book. It sounds like a good idea to keep around the house..

Do you know the name of the cop who busted you? I live here in Cack a lack and i run 120 up 77 to 85 to university almost twice a week. I keep a lookout for the lights but i am not too worried about them catching up. gotta get a tag that flips up http://www.gixxer.com/forums/images/graemlins/bitchslap.gif
