ok, so i got 2 tickets tonight. one for 117 in a 55, and one for driving betwen cars. on the ticket for speeding, the officer wrote my v.i.n. wrong. i have heard rumors about this being grounds for dismissal, but i am unsure how true it is. i will be contacting a lawyer tomorrow, but i wanted to see if anyone on the board had any experience with this sort of thing. thanks!

Its always funny when people get ticketed (and rightfully so) but they expect to get off on a technicality. Of course anyone would but you know the saying goes, "You play, you pay."

You better hope so, otherwise you're gonna be screwed. I'd seriously just hope that they let you keep your license much less getting the case thrown out, considering you broke 2 laws, speeding and lane splitting. Doing more than 2x the speed limit you're also lucky he didn't give you reckless driving.

I don't know if an incorrect VIN is grounds for that. Does it matter what vehicle you were doing 117 on? Point is you were doing it. Just curious, how off on the VIN was he, a number or 2 or was it way off like not even close?

You CAN get off on technicalities SOMETIMES. Most of the time the judge will dismiss if the screwup is bad enough, i.e. writing down the wrong statute. I'm not sure if the VIN will be enough though.

What you need to do is file a demand for discovery and get the records for the particular radar or lidar gun he used and make sure it was calibrated recently, check if they still have the license from the FCC to use it (they have to renew it preiodically), and make sure that he's been trained properly on how to use it (they also have to "freshen" up periodically).

On LI in suffolk County it is up to the PO how he handles it. He could have kept his lic. but unless he was running or being a dick wad they won't do the throw down and haul you away. And remember OJ and Micheal both got off why not Anthony

believe me, I've been pulled over for MUCH faster than 117 and didnt go to jail...its a common myth that you get automatic lock-up for excessive speeds...its possible, but uncommon http://www.gixxer.com/forums/images/graemlins/nono.gif

yeah, i definitely got lucky. the cop was very formal and straightforward, and i made sure i spoke very politely and formally to him as well. i think that may be why he didn't arrest me or impound the bike. we will see what happens with the tickets, i will be sure to post up the results when something does come from it.

more often than not, unless the cop is on the rag that day, your attitude is the determining factor on whether or not your are getting off, getting a ticket or going to jail for the night...I have never once given a cop an attitude, and I have gotten away with quite a few speeding tickets http://www.gixxer.com/forums/images/graemlins/smile.gif

I def. never said that I always obeyed the speed limit but when I get caught for something that I did wrong I dont try to fight it. I just figure I got off cheap for all the times I DIDNT get caught. As I said of course everyone wants to find away to get out of a ticket if they think they can but I cant remember the last time someone said, "Hey, got a ticket, that sucks so I guess I'm out a few hundred bucks." Instead every post about tickets ask for ways to get out of em. Truth is whether you get a lawyer or not a simple thing like a number or two off of a VIN isnt gonna buy you a ticket to Get Off Freeville. Depending on how much the tickets will end up costing and lingering effects (insurance, etc.), it may be better off to just pay up and be done with it. The attorney is gonna cost you some serious money...and then it may not make a difference. Really sounded like you got off pretty good.
