OL' MONN 04-07-2009, 09:20 PM (cannot have guns in England)
a guy in England killed one and wounded another that broke into his house at night. he shot when they came towards his bedroom.
He was arrested and charged with murder...
then the wounded dip stick sued his estate
it all started with registration.. then banning assualt guns..then banning handguns.. then shotguns.
keep'em.. but years behind bars if you get caught using it FOR ANY REASON.
WTF.. it's coming boys...

FWIW, they were unarmed, weren't attacking him and he shot them in the back when they tried to escape :dunno
Not that I don't agree that you should be allowed to defend yourself with whatever means necessary - but shooting burglars in the back as they are running away empty-handed isn't self defense :dunno
V2rider 04-08-2009, 06:09 AM ^ EXACTLY. No matter where you are, if someone is trying to get away from the situation and you shoot them, your fucked. In every state in the U.S. if they show up to see a guy shot in the back, plan on a long sit in a cell and never to see a gun again. You can not shoot a person trying to get away, its almost common sense. If I happen to be standing at the top of my stairs, and a person kicks my front door in and I shoot him in the chest, I'm fine, as MN has the Castle Doctrine. But if I walk around the corner, and he turns to run and I shoot him, Im in DEEP shit.:nono
Moto_Joe 04-08-2009, 07:00 AM not completely true. It will SERIOUSLY depend on the situation, and your jury really.
If a guy breaks into your house at night, you have NO way to know his intentions or if he is armed, and I for one am not taking the time to find out.
so I come out my bedroom door and the bad guy dives for "cover" since he sees my gun drawn down on him. Do I know he is "trying to get away" or is he buying time to get to his weapon......... I dont care at this point, I am shooting.
Id rather be tried by 12, than carried by 6.
Moto_Joe 04-08-2009, 07:00 AM FWIW, I dont know the story yet on the original post. I am just replying to the last couple posts.

Exactly - they were unarmed running away and he shot them needlessly. He had trouble with people before and he probably just had enough. I can empathize with him but his actions were completely criminal.
I remember a case where a man broke into a woman's house in the early hours in Luton, UK and came into her bedroom - she had a paring knife by the bed from eating a snack earlier that night. She awoke, jumped up and stabbed the man something like 60 times. He was unarmed but she was not prosecuted. Her life in my opinion in that case was in danger and she defended it and was not prosecuted. The story above just isn't self defense.
d7k8gsxr600 04-08-2009, 08:37 AM i follow the old addage that "if your found here at night, you be found here in the morning!"
if someone breaks into my house, which is against the law, im sorry im gonna shoot your ass. you dont belong here, you broke in, and that right there is enough for me to declare self defense. i dont care if your running for you life now because you should have thoguht about that before you broke in and threatened my well being!
just a thought.

I can understand that fully however do you really want to go to prison for murder over some scumbag that robbed you and is now running away? Life catches up with these people anyway. If it's face to face in your house, game on.

sluggo97 04-08-2009, 04:30 PM A buddy of mine who is a cop (LAPD) told me that if someone breaks in, you can claim self defense no matter what... just make sure the burglar is no longer breathing before calling EMS/PD.

I'm basing on the fact he turns and runs back out the front door. I am 100% sure your going to fight a long expensive losing battle in court if you shoot him in the back at that point.

Gotcha. He wouldnt make it that far :D :lol
I now know what you meant, but it is not what you said. You jsut said "trying to get away" and "shot in the back".
Dude tries to dive behind my kitchen island as I come out of the room...... he will more than likely be shot in the back. Oops. Like I said, I am not waiting to find out if he is jsut trying to get a gun out of his pocket
