Does anybody in the state of Indiana know anything useful that may help me with this charge. It is a Class A misdemeanor, and I didn't know if anybody on this board has ran into anything similar that I could use to my advantage.

THANKS

Yeah he was ducked in behind two cars that were behind me and I never saw him. He called the flatbed in to tow it off, then changed his mind and and decided he'd rather lecture me the whole time about how stupid it was to do such and thing. After he decided to let me know I was under arrest for and I qoute "tourqin' up a wheelie" aka wreckless driving in the fine state of Indiana... That I had no idea how to ride the "machine" I was on, and that he knows the power because he's raced bikes longer than i've been alive.

God bless America

If somebody wants to let me know how to post pics i'll post the paperwork, it's pretty funny because he wrote "wheelies" as the reason I was detained

:cheers

Why do you want "help" with the charge? You did it, right? And you got caught, right? Well suck it up and take your punishment. You are very close to falling into the "SQUID" category...

Wheelies are very hard to get out of... very hard. Here in Canada someone tried disputing a ticket they got for doing a wheelie... the judge got irritated and double the fine for wasting his time.

I am just asking for alittle advice from people who have prior experiences in this area to let me know what to expect when I go in to see the judge. I mean basically i'm just trying to not lose my license over the deal. Sorry for not making my intentions clear enough to you nit-picky superstar board members.

i got a wreckless here in alabama for lanesplitting on the interstate (yes very stupid move) you shouldn't loose your liscence.... a wreckless by itself in most states isn't enough points to have your liscence yanked.........however, in alabama a wreckless driving ticket carries a fine that can be imposed by the judge with no minmun and no maximum....so the moral of that is be respectful to the judge. don't give him any bs. i was honest with the judge told him what i did was stupid and that i knew better. he only fined me 50 bucks in addition to the court cost ...total was $188.........which isn't much more than just a speeding ticket......i did however loose six points on my liscence....as far as the insurance went......well to my suprise it never went up.......apparently they don't check your record unless you file a claim or change your policy................anyway don't sweat it....what's done is done....hope some of this helped.......:)

In Ga wreckless is a point MORE than DUI (DWI in some states). It alone wont cause loss of license either, but the minimum I think is like $250 fine, and max of like $1000.

I wish people would actually read posts before they decide to chime in on a subject, and to anybody who would like to comment on what I said in the above paragraph... Once again I understand what I did was against the law, I am only looking for somebody (ies) who have been in similar situations to give input on what punishments they faced for the action that the topic is about. I'm not asking for somebody to let me off the hook.

Thanks to the people who have posted input about the subject

In fact... yes..... when doing it in such a way as to put others in danger.

And not sacking up and taking what is coming to you is DEFFINATELY squidly.

Analogy.

You walk into the grocery store, try to steal something, and get caught. Should you not go to jail, or at least be prosecuted for theft?

Sure you should.

Whats the difference here. When you knowingly break the law (most of us do it on a dialy basis) be prepared to face the punishement should you be caught.

FWIW........ I can call people squids......... cause I ARE ONE :squid. Thus the reason I dont ride street anymore. I took it to the track where riding like a lunatic (within reason of course) is acceptable :p

Just have to save the wheelies for celebrations and cool down laps :shifty

I totally agree with what motojoe has said, and not once did I claim that I was going to atempt to dodge the charge. I was just trying to see what other people on this board got as far as punishments go. I usually save the stuff for the warehouses and keep it off the roads, but lesson learned.

The cop did comment that he was impressed that I atleast had gear on.

miltonbx152
06-30-2007, 09:59 PM
And i'm not too sure how this whole thing got flipped around. Honestly I dont think anybody is any smarter than the next... If you get on a bike and ride it on a public roadway you take a risk of getting hurt badly, or even dieing... wether its your fault or not. So in a sense I guess everybody is what you guys like to call a "squid". I guess this post was just a way for me to ask a question and vent at the same time. I'm not trying to fight the charge, i'm sure the video camera in the squad car has plenty of evidence of my guilt on it, it was a stupid thing to do and I was just trying to find out what kind of shit I got myself into.

Well, I live in NY. I had a similar incident. I was doing a "cat walk" (stoppie while rollin), and it just so happened that there was an undercover police car RIGHT BEHIND ME!

Well he pulled me over and ripped into me good about how he rides and this and that. Then he said I was not in control of my vehicle. I simply replied, "Did you even see what I did?, I could have set my tire on your bumper if I wanted to". I said it with a grin, and believe it or not, he let me go with a warning.

I count myself pretty lucky.

Best bet is to get a lawyer, and hopefully he/she can knock it down to a lesser charge, not much else you can do. Anyway you look at it you're going to have to pay a nice chunk of change through fines and insurance. Good luck man, hope you don't lose your license.

Guys, this IS america. Thats WHY there are lawyers. If your so bent out of shape about it, call up a lawyer and see if they can do anything. At the very least they can plead you down to careless and maybe with hold points. You WILL pay a fine, but thats way better than a reckless ticket.

In florida, a reckless ticket is a FELONY, so your lucky as fuck.

There are two kinds of sport bike riders, those who pop wheelies and those who lie about it.

The thing to remember is that there is a time and a place for everything. You just so happen to pick the wrong time and place.

As far as your punishment, t is really going to depend on how much of a dick the cop/judge tries to be, if he has had his morning coffee or been laid recently.

Not sure how comparable Indiana is to Virginia. But our rules, penalties, and fines all increased starting today. Fines now carry over annual payments for 3 years and you cannot renew your registration unless you have paid up.

Well in my defense i'm not claiming what I did was right, and or a very smart action to take. If anybody was to read any of my posts that i've made you would of read that "I normally save it for the warehouses" and had a slight brain fart and decided I wanted to ride one down the countries oldest national road. As far as " hitting your wife and kids" dont worry about that buddy luckly I dont live in your town so I wont fear your "wrath" but thank you for the advice.

they need to pass a law that if your caught stunting they take your bike and crush it like they are doing to people's cars caught racing in cali :biggrin
I agree . Some people take stunting too far . Thats not what the bike was made for . It's made to ride on the street and the race track . It's not produced so somebody can ride it around in a circle on the back wheel in a deserted parking lot . I know everybody is different and likes different things but what is the point ? Who wants a bike with the front upper zip tied to the stay bracket and the gas tank smashed to a pulp with no plastics at all ?

I am not sure why all of you are attacking the chap. He did a wheelie, BFD!

Get an attorney that specializes in traffic law. Pay the man (or woman) his (or her) money to do what he (or she) does best.

The traffic laws are mostly made to....get revenue. I think that a properly executed wheelie at a reasonable speed is no more risky than taking a tight curve or a large dump truck on I95 at the speed limit. Time and place people!

As for what these bikes were designed for, they have a better power to weight ratio than most race cars. They aren't designed to do 45 mph. In fact, my bike and my old bones (wrists) especially aren't comfortable until about 80 mph which is speeding in most places.

Let he (or she) who is without sin and wheelie, cast the first stone.

Flame on dude (and dudette).

i live in wisconsin now but used to live in indiana for about 6 years. i got a few of those charges.
i can honestly say without question that a lawyer is your only way to go. tell your lawyer that you want it bumped down and he'll do it.

also, there's to forms of wreckless driving.
one which endagers others and one which does not.

if he wrote it up as the one which endangers others and you were the only one on the road at the time, then your lawyer can have it thrown out. mine did.

but either way, if you want anything less than that, get a lawyer

Best post in this thread :punk Accident’s happen all the time. I believe someone who speeds a little is usually more alert then a dumb soccer mom in an SUV way to big for her to stay in her lane. I once saw a guy eating a bowl of cereal while driving. I don't think I come close to that but wheelie ALL THE TIME!:cheers All of you fags that think your shit doesn't stink can kiss my big fat ass. If they don't make money from you by doing stupid shit or doing a wheelie, then comes the stupid shit like not using your turn signal shit like that. They do it to keep their jobs.:cursing I just hate all you fags that thing your worthy enough to use the term squid like your some fucking AMA all-star and don't do anything wrong. I bet half of you drink and drive, take pills, smoke weed, cheat etc. (Something illegal that endangers others) I don't see anywhere in the bible where it says man shall not wheelie lol. I also know in Alabama it is illegal to give/receive oral copulation, someone here lives there or has. We are all going to die someday, if you look at accident statistics it clearly shows 70% of accidents are from drivers not paying attention and drunk drivers; not from reckless driving. I have been driving and riding like I have for 10 years yet I have not one accident on my record. I also avoid 20+ accidents a week from other drivers not paying attention. Another thing I am sick of is this accident forgiveness shit from allstate. FUCKING WATCH THE ROAD DIPSHITS! My rant is over to those that have the holier then thou attitude. Anyone of you would get out of the ticket if you could I am 100% sure of that.

Honestly, the best thing you can do is get a traffic lawyer and fight the shit. Get them to reduce it and the fine. Tell them something like your friends can all do it and you just wanted to learn but now you realized how dumb it was and you are selling the bike and don’t hang out with those bad influence of friends. Talk their ear off but make it believable and don’t go over the top with it. I get out of almost all my tickets by simply asking the officer to be honest and tell me that even though it is illegal it was the right place and time. I have been let go 4 times this year already for speeding because the conditions were clear and dry. I have also recently been cited for reckless driving. However I was able to prove in court that I did not wantonly and willfully disregaurd others safty but simply split/shared lanes. Its legal in cali :punk

To me, after reading a hell of alot of posts about have I got too much air in my clip on's, will a 520 con. ver. give me 10hp and is there too much nitrous under my seat, this just is the straw that breaks the camels back.
F uck! Like a few others have said, just accept the fact you got caught and don't ask for help about how to get out of it.
If it is that much of a worry don't do them in the first place.

Does anybody in the state of Indiana know anything useful that may help me with this charge. It is a Class A misdemeanor, and I didn't know if anybody on this board has ran into anything similar that I could use to my advantage.

THANKS
Sorry to hear it, pal. In Nevada the criteria for reckless/aggressive driving are as follows:
A driver commits an offense of aggressive driving if, during any single, continuous period of driving within the course of 1 mile, the driver does all the following, in any sequence: (a) Commits one or more acts of speeding in violation of NRS 484.361 (http://www.leg.state.nv.us/NRS/NRS-484.html#NRS484Sec361) or 484.366 (http://www.leg.state.nv.us/NRS/NRS-484.html#NRS484Sec366).
(b) Commits two or more of the following acts, in any combination, or commits any of the following acts more than once:
(1) Failing to obey an official traffic-control device in violation of NRS 484.278 (http://www.leg.state.nv.us/NRS/NRS-484.html#NRS484Sec278).
(2) Overtaking and passing another vehicle upon the right by driving off the paved portion of the highway in violation of NRS 484.297 (http://www.leg.state.nv.us/NRS/NRS-484.html#NRS484Sec297).
(3) Improper or unsafe driving upon a highway that has marked lanes for traffic in violation of NRS 484.305 (http://www.leg.state.nv.us/NRS/NRS-484.html#NRS484Sec305).
(4) Following another vehicle too closely in violation of NRS 484.307 (http://www.leg.state.nv.us/NRS/NRS-484.html#NRS484Sec307).
(5) Failing to yield the right-of-way in violation of any provision of NRS 484.315 (http://www.leg.state.nv.us/NRS/NRS-484.html#NRS484Sec315) to 484.323 (http://www.leg.state.nv.us/NRS/NRS-484.html#NRS484Sec323), inclusive.
(c) Creates an immediate hazard, regardless of its duration, to another vehicle or to another person, whether or not the other person is riding in or upon the vehicle of the driver or any other vehicle.

I'd suggest you check the laws in Indiana...
IC 9-21-8-55
Aggressive driving
Sec. 55. (a) This section does not apply to a law enforcement official engaged in the law enforcement official's official duties.
(b) For purposes of this section, a person engages in aggressive driving if, during one (1) episode of continuous driving of a vehicle, the person does or commits at least three (3) of the following:
(1) Following a vehicle too closely in violation of IC 9-21-8-14.
(2) Unsafe operation of a vehicle in violation of IC 9-21-8-24.
(3) Overtaking another vehicle on the right by driving off the roadway in violation of IC 9-21-8-6.
(4) Unsafe stopping or slowing a vehicle in violation of IC 9-21-8-26.
(5) Unnecessary sounding of the horn in violation of IC 9-19-5-2.
(6) Failure to yield in violation of IC 9-21-8-29 through IC 9-21-8-34.
(7) Failure to obey a traffic control device in violation of IC 9-21-8-41.
(8) Driving at an unsafe speed in violation of IC 9-21-5.
(9) Repeatedly flashing the vehicle's headlights.
(c) A person who, with the intent to harass or intimidate a person in another vehicle, knowingly or intentionally engages in aggressive driving commits aggressive driving, a Class A misdemeanor.

Unless your summons/citation/ticket indicates "reckless driving" specifically you might be able to talk your way out of it. To whit...Sorry your honor, my throttle got stuck as I down shifted, then I panic'd and jerked the throttle and subsequently the front wheel came up. But as the definition of reckless driving doesn't apply because I didn't commit any of the criteria, I don't know why I'm here. Thank you, your honor.

I never wheelie in traffic, only open roads where Im no danger except to myself & my bike lol. Also in Texas, they usually never pursue after 100 mph.
So in short, mine start at 80 and level usually around 120-135,they'll usually never pursue, weird huh?
As long as there is sportbikes, there will be guys who wheelie.I agree flame someone for wheelies in traffic & populated areas, but if your flaming simply because he rides a wheelie? Maybe you should register at the "Harley pozer wannabe forum"

+1 I don't understand people who judge others when we all do things that are not right no matter how small or big. With a power to weight ratio that our bikes have, I don't think anyone had the law in mind when they signed that check. :dissapointed

Get a lawyer and pay him whatever he asks. Trust me, it will save you twice as much at the end of the day. Good luck.

Austin PD pursue if they are on their BMW K1200S. Have a buddy on a CBR1000 to confirm. When the cop pulled him over (after catching up with him at speeds over 100), the cop said "nice chase huh?" Went on to say, "now slow down." No ticket no warning. Guess the cop got an adrenaline rush and a hard on and his day was made!

Best thing is a lawyer, that and your driving record. If it's bad, then it's gonna be hard for you, if it's good, then the judge might see you are just human and everyone makes mistakes and go easy. A good analogy is credit, good = low interest, bad = high interest, moral of the story, get a good lawyer and pray your record isn't that bad, careless is better than reckless, good luck man.

Not trying to avoid the charge is the standup thing to do....However in this country you do have the right to attempt to get out of it. At the very least get the minimum charge. Because of the severity of the fine I would definitely get a lawyer. He may not get you out of it but he can at least plead you down to a lessor charge.

Ha once again i'm really tired of hearing this squid shit... I am just asking for alittle advice from people who have prior experiences in this area to let me know what to expect when I go in to see the judge. I mean basically i'm just trying to not lose my license over the deal. Sorry for not making my intentions clear enough to you nit-picky superstar board members.

P.S. i'm fully aware of what I did today and take resposibility for my actions

THEN SHUT THE FUCK UP AND TAKE RESPOSIBILITY! You say you are tired of the "squid" shit? It's like you are the smart ass punk kid who mouths off to the school bully, get shis ass kicked then runs home and cries to mommy.

Now enough of the hard shit, man up, go to court, dress decently, Kahki pants, shirt, maybe a tie , be respectful, when you get there and check in at the window or whatever ask if it would be okay to talk to the prosecuter before. Tell him that you fully understand what you did was wrong, totally immature, knowing full well the danger you put, not only yourself in but all the other motorists on the road that day. Ask if there is anything that we may be able to work out in the way of a fine vs. loss of license or points. Bottom line they want $$$. When you go in front of the judge humble yourself, look him right in the eyte , apologize, admit what you did was wrong and careless and ask for just one chance and promise that they will never see you in that court again for such an immature action... Good luck

Duude your such a :squid

You actually wheelied a sportbike? How could you? That's so selfish and wreckless. You put your life and everyone else on the road in immediate danger! I hope they take your licence and never give it back to you. Your a criminal and a danger to our society. Of course the bikes are designed to drive wreckless but if you actually use them for what they are made for your a squid. Sport bike are just for looks you don't actually use them. Studys have shown only 4% of riders actually ride at the track. I bet your one of them hotshot guys that rev the motor up over 2 or 3 grand when accelerating. Sportbikes should be illegal! Too many guys are buying them and riding them the way they were designed to be ridden. :lol:lol I was testing out my new bike before I bought it the other day and when the rpms got high it poped up in a small wheelie on it's own unexpectedly. After I pulled over I felt like such a scum bag even though it was an accident I was going to report myself to the cops so I could get my ticket. (all sarcasm)

Listen in all seriousness these bikes were designed and knowingly sold to drive like this. If he is a squid then we are all squids for buying race bikes to begin with. On the street running the bike thru a gear or two, leaning down a bit around sharp corners, and exceeding the speed limit from time to time is a expected part of the sportbike riding style. Everyone here does it to some extent and if not they would of bought a cruiser or goldwing instead. The more mature of us just know when to say when and we limit our recklessness. The squids go all out without limits, top speed runs on the highway, racing, high speed cornering, running from the cops exc exc.

This is a squid! The difference is the level of recklessness some don't have limits and anything goes.

Don't forget driving & riding on public roads is a PRIVILEGE. NOT a RIGHT.

Are you serious? You better read the constitution brother :scratch Do you work for the government?

For years professionals within the criminal justice system have acted on the belief that traveling by motor vehicle was a privilege that was given to a citizen only after approval by their state government in the form of a permit or license to drive. In other words, the individual must be granted the privilege before his use of the state highways was considered legal. Legislators, police officers, and court officials are becoming aware that there are court decisions that disprove the belief that driving is a privilege and therefore requires government approval in the form of a license. Presented here are some of these cases:

CASE #1: "The use of the highway for the purpose of travel and transportation is not a mere privilege, but a common fundamental right of which the public and individuals cannot rightfully be deprived." Chicago Motor Coach v. Chicago, 169 NE 221.

CASE #2: "The right of the citizen to travel upon the public highways and to transport his property thereon, either by carriage or by automobile, is not a mere privilege which a city may prohibit or permit at will, but a common law right which he has under the right to life, liberty, and the pursuit of happiness." Thompson v. Smith, 154 SE 579.

It could not be stated more directly or conclusively that citizens of the states have a common law right to travel, without approval or restriction (license), and that this right is protected under the U.S Constitution.

So you want to argue that you can lawfully drive/ride without a license? Because its a right, correct? :wtf:banghead

You are misinterpreting those cases and state law. Do you have a motorcylce license? If so WHY? DO you have a drivers license for a passenger vehicle? If So WHY?

:phhht

Because some of the powers that be in government like to pervert our rights and brainwash us into thinking we don't have any. The right to travel is not a privilege it's a right. We do not need permission from our government to tell us we can drive or pay them a fee to be able to drive just like there is no law that requires us to pay income tax but we just go along to get along.

Answer my question do you have a license(s)?

yes siiir I got my license at 16 like most of us. At that age I just did what I was told to, I did not think for myself. I have been driving for 14 years with spotless driving record, ZERO accidents of any kind what-so-ever. A while back I got my motorcycle permit but never bothered to get the motorcycle endorsement.

The thought of paying hundreds of dollars a month or thousands of dollars a year to be able to have the "privilege" to drive or right to travel granted to us is ludicrous. Requiring people to get permission to drive is unconstitutional but under the argument of safty driving testing may be understandable. What is not is the money that you have to pay the DMV to register, renew licenses, insure and all the other bs taxes that the government likes to invent.

You pay us money and we will give you permission to drive, you do not give us money and you can't. :dissapointed

I had to work a wreck a couple of weeks ago where some dumbass was doing a wheelie on I-85 and lost control. He was cut in half by a light pole.
